Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the websites, software, automation and workflow products, and services provided by Cloud Magic Software Group ("CMSG," "we," "our," or "us") (collectively, the "Services"). By purchasing, installing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. The Products
We sell and distribute software and automation/workflow products, including pre-built workflow templates and integrations distributed through third-party marketplaces such as Gumroad, HubSpot, Shopify, and monday.com ("Marketplace Products"). Product descriptions, supported platforms, and any limitations are stated in each product's listing.
3. License
Unless a product listing states otherwise, your purchase grants you a non-exclusive, non-transferable, perpetual license to use the purchased product for your own business or that of a single client per license. You may not resell, redistribute, sublicense, or publicly republish the product or its source as a competing product. License terms specific to a marketplace platform also apply where the product is distributed through that platform.
4. Orders, Pricing, and Payment
Prices are listed on the product listing or our website and may change at any time. Purchases are processed by our payment providers (Stripe and Gumroad) or by the marketplace through which you bought the product. You are responsible for any taxes not collected at checkout.
5. Refunds
Because our products are digital goods delivered immediately, sales are generally final. We will, however, consider refund requests for products that are materially defective or that do not function as described, when reported within 14 days of purchase. Where you purchased through a marketplace, that marketplace's refund policy may also apply.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Reverse engineer, decompile, or attempt to extract source for the purpose of building a competing product
- Use the Services to send spam or to process data you are not authorized to access
- Interfere with or disrupt the integrity or performance of the Services or any connected platform
7. Third-Party Platforms
Our Marketplace Products connect to third-party platforms (such as HubSpot, Shopify, monday.com, Supabase, Stripe, and Gumroad) using credentials and permissions you provide. Your use of those platforms is governed by their own terms. We are not responsible for changes, outages, or data handling by third-party platforms.
8. Data and Privacy
Our collection, use, and protection of your data is governed by our Privacy Policy. By using the Services, you acknowledge and agree to the data practices described therein. For Marketplace Products, we only access and process the platform data necessary to provide the functionality described in the product listing, and we do not sell or share your platform data with third parties for their own purposes.
9. Support and Updates
Support and update terms are described in each product listing. Unless stated otherwise, support is provided on a reasonable-effort basis via support@cloudmagic.software. We may release updates or discontinue a product; we will make reasonable efforts to notify active customers of breaking changes.
10. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or compatible with every configuration of a third-party platform.
11. Limitation of Liability
To the maximum extent permitted by law, CMSG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless CMSG from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
